Article VI: Dispute Resolution

Dispute resolution within the Optio Blockchain community is essential for maintaining harmony, trust, and collaboration.

 

This article outlines the processes for mediation and arbitration, as well as the code of conduct that all community members are expected to follow.

Mediation and Arbitration

Effective dispute resolution is crucial for ensuring that the community can function smoothly and cooperatively.

  1. Mediation by The Council of Ordinals:
    • The initial step in the dispute resolution process involves mediation by The Council of Ordinals. When conflicts arise between community members, the council acts as a neutral mediator to facilitate dialogue and seek a mutually agreeable resolution.
    • Mediation aims to address issues promptly and amicably.
    • The council employs a structured mediation process, which includes identifying the root causes of the dispute, encouraging open communication, and exploring potential solutions collaboratively.
  2. Formation of an Independent Arbitration Panel:
    • If mediation fails to resolve the dispute, an independent arbitration panel may be formed. This panel consists of impartial individuals who are not directly involved in the conflict and who possess the expertise and integrity to render fair judgments.
    • The arbitration panel is selected by the Optio Consortia DAO through a proposal from the Council of Ordinals.
    • The panel reviews the evidence, hears arguments from all parties involved, and renders a binding decision. This decision is final and must be respected by all parties, ensuring that the dispute is conclusively resolved.
  3. Transparency and Fairness:
    • The dispute resolution process is conducted transparently, with all proceedings documented and made available to the community.
    • Both mediation and arbitration are guided by the principles of fairness, impartiality, and respect for all parties involved. The aim is to achieve just resolutions.
  4. Legal Oversight in Dispute Resolution:

 

  • Legal representation may also assist in resolving disputes involving community member removals, especially during mediation or arbitration. Their role will ensure that all actions taken are consistent with the constitution, code of conduct, and broader legal frameworks.
